Losing a license is an enormous hardship. Unfortunately, there are many ways that one can lose the privilege to drive. Fortunately, it is usually easy to figure out HOW to restore one’s driving privileges.

How a Loss of License Can Occur & WHAT I CAN DO TO GET IT BACK FOR YOU

Many criminal convictions result in an automatic loss of license (even when a vehicle is not involved in the crime, as in a drug possession case), and, unfortunately, it has been my experience that lawyers sometimes do not tell their clients that they will lose their license upon being convicted. The client then finds out about the suspension only upon getting a notice from PennDOT. This is unfortunate and should never occur.

A loss of license can also be triggered, of course, by a DUI conviction, a conviction for Driving While Suspended, for Driving Without a License, for School Bus violations, and, most notably, for being a minor in possession of or consuming alcohol. The last are the most frequent source of trouble in Pennsylvania because neither the police nor the Courts notify the client that there is a suspension of 90 days, 1 year or 2 years attached to a conviction. The uninformed client usually pleads to the charge because “it’s only a ticket” and then gets that nasty notice from PennDOT.

I have not even touched on medical recall of driving privileges for medical reasons. This can happen when seeing a physician for a seizure disorder or just a loss of consciousness (i.e., fainting) and the physician notified PennDOT, which then recalls driving privileges pending physician clearance to drive. These cases happen all the time and require prompt action.

What I have learned over the years is that the laws of the Commonwealth are traps for the unwary when it comes to a loss of license. Many criminal defense lawyers do not know what they are doing with license suspensions and do not notify their clients appropriately. Also, sadly, too many people give up hope that they will ever get their license back. This is nonsense. An experienced attorney can assist in preventing a license suspension from occurring, managing it if it happens, and restoring lost driving privileges.
