The basics of DUI require that a person drive, operate or be in actual physical control of a motor vehicle on a highway or thruway of the Commonwealth of Pennsylvania while under the influence of alcohol or drugs so as to be rendered incapable of safe driving. Penalties vary depending on two factors: what is in the person’s breath or blood (and, if alcohol, how much of it?) and how many prior DUI offenses has the person been convicted of in the last ten years? In theory, one simply adds the two factors together and a penalty applies. But it is not so simple.

The Issues - DUI and DWI Attorney

The first issue involves “driving, operating or actual physical control." Driving and operating a car are easy enough, but what about “actual physical control”? What if police find a driver asleep behind wheel of a parked car, engine running? Depends where it is. Is the car parked on the side of the road or is it parked in the bar where the driver was just drinking? The first is more likely to be DUI because the car had to get on the road somehow (but even then, there are issues) while the second is less likely a DUI because it is reasonable to infer that the patron went to his car and then dozed off. Many, many cases involve variations on this theme, and it is a crucial point: there can be no DUI if a person is not in “actual physical control” of a vehicle.

The second issue concerns highways and thruways of the Commonwealth. Obviously, a public street qualifies and a driveway up to a house does not. But what about a “Private Drive” in a gated residence? Or the parking lots of an apartment complex? Again, there can be no DUI unless a vehicle is on a highway or thruway.

More generally, there are concerns about whether police had the right to stop or detain a vehicle, whether they could question the driver, whether the person was impaired according to field sobriety testing, whether the tests were administered according to prescribed National Highway Traffic Safety Administration standards, whether blood was collected by consent or pursuant to a warrant, whether it was collected within two hours, etc.

As comprehensive and dense as all of this is already, it does not even begin to scratch the surface, so to speak, of DUI law.
