DUI

DUI Defense Lawyer in Bucks County, Pennsylvania

In no area of practice does Mr. Logan have more experience than DUI. As a DA, Mr. Logan prosecuted hundreds and hundreds of these cases. As a DUI defense attorney in Bucks County, PA, he has, similarly, defended hundreds of them. As a defense attorney, he has lost only two cases thus far.

PENNSYLVANIA LAWS ON DRIVING UNDER THE INFLUENCE ARE BOTH SIMPLE AND, IN INTERESTING SPOTS, VERY COMPLICATED.

The basics of DUI require that a person drive, operate or be in actual physical control of a motor vehicle on a highway or thruway of the Commonwealth of Pennsylvania while under the influence of alcohol or drugs so as to be rendered incapable of safe driving. Penalties vary depending on two factors: what is in the person’s breath or blood (and, if alcohol, how much of it?) and how many prior DUI offenses has the person been convicted of in the last ten years? In theory, one simply adds the two factors together and a penalty applies. But it is not so simple.

The Issues - DUI and DWI Attorney

The first issue involves “driving, operating or actual physical control." Driving and operating a car are easy enough, but what about “actual physical control”? What if police find a driver asleep behind wheel of a parked car, engine running? Depends where it is. Is the car parked on the side of the road or is it parked in the bar where the driver was just drinking? The first is more likely to be DUI because the car had to get on the road somehow (but even then, there are issues) while the second is less likely a DUI because it is reasonable to infer that the patron went to his car and then dozed off. Many, many cases involve variations on this theme, and it is a crucial point: there can be no DUI if a person is not in “actual physical control” of a vehicle.

The second issue concerns highways and thruways of the Commonwealth. Obviously, a public street qualifies and a driveway up to a house does not. But what about a “Private Drive” in a gated residence? Or the parking lots of an apartment complex? Again, there can be no DUI unless a vehicle is on a highway or thruway.

Mr. Thomas Logan – Experienced DUI Defense Attorney

More generally, there are concerns about whether police had the right to stop or detain a vehicle, whether they could question the driver, whether the person was impaired according to field sobriety testing, whether the tests were administered according to prescribed National Highway Traffic Safety Administration standards, whether blood was collected by consent or pursuant to a warrant, whether it was collected within two hours, etc.

As comprehensive and dense as all of this is already, it does not even begin to scratch the surface, so to speak, of DUI law.

ANYONE charged with DUI should retain experienced counsel from a DUI defense lawyer in the Bucks County area. The reason is simple: DUI laws in Pennsylvania are very harsh and unforgiving. Even someone with no prior criminal record can go to prison for a DUI offense and suffer a long license suspension. Because the law is so harsh and consequences of a conviction so severe, a DUI defense lawyer or DWI defense attorney should be consulted. It can make all the difference, and what is, after all, the value of no loss of license, no jail time, and no conviction? Incalculable.

“TOM ACHIEVED RESULTS FOR ME THAT NO ONE EXPECTED,”

well above and beyond what his own goals for the case were. He was kind, compassionate and always made me feel like an honorable human being despite the trouble I found myself in. He was easy to reach, responded always in a very timely manner, and was well prepared. I would recommend Tom to anyone in need of legal representation.

“GETTING IN TO LEGAL TROUBLE IS NEVER FUN.”

The first thing that stuck out to me was how quickly Tom reached out to me after doing an online inquiry. Because of the nature of my case it required immediate attention and he save me a lot of headaches. Secondly, my anxiety throughout was put to rest as I knew I was in good hands and that Mr. Logan would go above and beyond to protect my interests. I could not be more satisfied with the representation I received and the advice I was given. He's as good as it gets.

“I COULD NOT HAVE ASKED FOR BETTER REPRESENTATION.”

Tom was very prepared and ready for any possible outcome during my entire defense. His aggressive strategy, in my particular case, caused the DA to over look charges that no doubt would have been added if they had enough time to properly investigate. If those charges were added, it would have been very easy for them to prove my guilt and I would have lost everything. For this I am utmost grateful for Tom's stunning work! However what meant more to me than his remarkable representation was that he genuinely cared about my well being. Wisdom can be offered by all ages, and Tom shared a lot of it with me.

“A LAWYER YOU CAN COUNT ON,”

I was so grateful to have Thomas Logan assigned to my case. He immediately helped put my mind at ease by focusing on information and best next steps. Together we devised a plan and put our plan into action. I trusted that he would guide me towards the most favorable outcome for my case and he did. I highly recommend this lawyer with complete confidence.
